These Booking Terms & Conditions (the “Terms”) govern all Reservations at MINOS, République and Cocoa Room at JON, Al-Seef, operated by Gastronomica General Trading Co., Commercial Registration No. 110371 (the “Company”, “we”, “us” or “our”).
These Terms comprise Part A (General Terms), Part B (Outlet Schedules) and Part C (Guest Acknowledgement & Declaration). In the event of any conflict, the Outlet Schedule prevails in respect of that Outlet.
Part A – General Terms
1. Definitions and Interpretation
1.1 In these Terms:
(a) “Booking Guest” means the person in whose name a Reservation is made;
(b) “Booking Platform” means any website or application through which a Reservation is made, including the Company’s own website;
(c) “Business Day” means any day other than a Friday, a Saturday or an official public holiday in Kuwait;
(d) “Confirmation” means the written or electronic confirmation of a Reservation;
(e) “Grace Period” means the maximum period of fifteen (15) minutes from the confirmed reservation time;
(f) “Guest” means the Booking Guest and each person included in the Booking Guest’s party;
(g) “Management” means the Outlet’s duty manager or any other person authorized by the Company;
(h) “Outlet” means each of MINOS, République and Cocoa Room, and “Outlet Schedule” means the schedule applicable to that Outlet in Part B;
(i) “Prepayment” means the advance payment required to confirm a Reservation under the applicable Outlet Schedule;
(j) “Reservation” means a table booking at an Outlet for a specified date, time and number of Guests; and
(k) “Time Slot” means the reserved period stated in the applicable Outlet Schedule.
2. Scope, Acceptance and Formation
2.1 By making a Reservation, the Booking Guest accepts these Terms on his or her own behalf and on behalf of every Guest in the party and shall ensure their compliance with them.
2.2 A Reservation becomes binding only upon issuance of the Confirmation and, where required, receipt of the Prepayment in full.
2.3 The Booking Guest accepts these Terms, including Part C, by ticking the acknowledgement box at booking. The Company’s electronic records of the Reservation and of such acceptance (including its date, time and the version accepted) constitute evidence under Law No. 20 of 2014 on Electronic Transactions.
3. Reservations
3.1 Each Reservation is for the Time Slot set out in the applicable Outlet Schedule, which runs from the reserved time irrespective of the Guests’ arrival time.
3.2 Tables are held for a maximum of fifteen (15) minutes from the confirmed reservation time (the Grace Period), after which the Reservation may be cancelled and the table released without notice. Management may, at its discretion and subject to availability, seat Guests arriving after the Grace Period, in which case the Prepayment remains redeemable in accordance with Clause 4.4.
3.3 Outside food, beverages and celebration items (including cakes) are not permitted unless pre-approved by Management, and any applicable charge will be notified in advance.
3.4 Reservation is personal to the Booking Guest and may not be sold or transferred without the Company’s prior consent.
4. Prepayment
4.1 Where the applicable Outlet Schedule so requires, a Prepayment is payable per Guest to confirm the Reservation, through the Booking Platform or a payment link issued by the Company.
4.2 The Prepayment must be completed within five (5) minutes for online bookings, or within thirty (30) minutes of a payment link being sent by the Company, failing which the booking request will expire automatically, and the table will be released. Any payment received after expiry will be refunded in full.
4.3 The Prepayment is an advance payment on account of the final bill and represents the minimum spend per Guest. It is not a booking fee or earnest money and confers on neither party a right to withdraw from the Reservation.
4.4 The Prepayment is redeemable against the final bill only on the date, at the Outlet and for the Time Slot of the Reservation. Any unused balance is non-refundable and may not be exchanged for cash, carried forward or transferred.
4.5 Where fewer Guests attend than the number confirmed in the Reservation, the Prepayment for the absent Guests is non-refundable; however, the full Prepayment remains redeemable against the final bill in accordance with Clause 4.4.
5. Cancellations, Modifications and No-Shows
5.1 Any cancellation or modification must be notified at least twenty-four (24) hours before the reserved time, through the Booking Platform or the contact details in the Confirmation.
5.2 Where the number of Guests is reduced at least twenty-four (24) hours before the reserved time, the Prepayment for the reduced Guests will be refunded in accordance with Clause 5.3. Any later reduction is governed by Clause 4.5.
5.3 Where a Reservation is cancelled in accordance with Clause 5.1, the Prepayment will be refunded in full to the original method of payment within fifteen (15) Business Days, subject to the processing times of banks and payment service providers.
5.4 Where (a) no Guest attends, (b) the Guests arrive after the Grace Period and are not seated, or (c) the Reservation is cancelled less than twenty-four (24) hours before the reserved time, the Prepayment shall be forfeited to the Company as agreed compensation, which the Booking Guest acknowledges is a genuine and reasonable pre-estimate of the Company’s loss in holding the table and forgoing other bookings.
5.5 The Company may decline future Reservations from, or require a Prepayment from, any Booking Guest with repeated no-shows or late cancellations.
6. Cancellation by the Company and Force Majeure
6.1 The Company may cancel or reschedule a Reservation by reason of adverse weather, operational requirements or any event beyond its reasonable control, including utility failures, directives of the competent authorities, public health measures and emergencies.
6.2 The Company shall notify the Booking Guest as soon as reasonably practicable, and the Booking Guest may elect either a full refund of any Prepayment within fifteen (15) Business Days or to rebook at the same Outlet, subject to availability, as his or her sole remedy.
7. Dress Code and Age Policy
7.1 National and traditional dress, including traditional sandals worn with it, is accepted at all Outlets.
7.2 Guests shall comply with the dress code and age policy in the applicable Outlet Schedule. Management may request proof of age and may, acting reasonably, refuse entry to any Guest who does not comply, and such Guest shall be treated as not having attended for the purposes of Clauses 4.5 and 5.4.
8. Guest Conduct and Responsibility
8.1 Management may, acting reasonably, refuse entry or service to, or ask to leave, any Guest whose conduct is disruptive, unsafe, offensive or contrary to public order or morals, or who otherwise breaches these Terms. The bill for all items ordered remains payable, and any unused balance of the Prepayment is forfeited.
8.2 Smoking is permitted in designated areas only, in accordance with the applicable laws.
8.3 Guests shall be liable, in accordance with the law, for any damage they cause to the premises, furniture, fixtures or equipment of the Outlet.
8.4 Guests are responsible for their personal belongings, and the Company is not liable for their loss or damage unless caused by the fault of the Company or its staff. Lost items are held for thirty (30) days and then dealt with in accordance with the law.
8.5 Personal photography is permitted, provided it does not disturb others or capture other guests without their consent. Commercial photography, filming or content creation requires Management’s prior written approval.
9. Allergies and Dietary Requirements
9.1 Guests must disclose any food allergy, intolerance or dietary requirement at the time of booking and again upon arrival.
9.2 While reasonable precautions are taken, the Outlets use shared kitchen equipment, and no dish can be guaranteed free from allergens.
9.3 The Company shall not be liable for any reaction arising from an allergy, intolerance or dietary requirement not disclosed under Clause 9.1. Nothing in this Clause 9 limits Clause 10.2.
10. Liability
10.1 The Company shall not be liable for any indirect, consequential or unforeseeable loss, including loss of opportunity and travel or transport costs.
10.2 Nothing in these Terms shall exclude or limit the Company’s liability (a) arising from its fraud or gross negligence, (b) for death or personal injury, (c) arising from an unlawful act, or (d) which cannot otherwise be excluded or limited under the laws of the State of Kuwait.
11. Personal Data and CCTV
11.1 Personal data, including contact, allergy and dietary information, is used to manage Reservations, communicate with Guests and provide the Company’s services, and for marketing only where the Booking Guest has opted in, in accordance with the Company’s Privacy Policy and the applicable laws.
11.2 The Company may share personal data with Booking Platforms and payment service providers solely to the extent necessary to process the Reservation and any Prepayment.
11.3 The Outlets are monitored by CCTV for safety and security. Recordings are retained for a limited period and disclosed only where required by law or by the competent authorities.
12. Group Bookings, Private Events and Booking Platforms
12.1 Reservations forseven (7)or more Guests, private events and exclusive-use bookings are subject to separate terms, which prevail over these Terms in case of inconsistency.
12.2 Reservations made through a Booking Platform are subject to these Terms, which prevail over any conflicting terms of that Booking Platform.
13. Amendments
13.1 The Company may amend these Terms by publishing the amended version on its website and Booking Platforms. Amendments apply only to Reservations made on or after the date of publication.
14. Complaints, Governing Law and Jurisdiction
14.1 Complaints may be addressed to the Company at info@jonkuwait.com or (+965) 1858000, preferably within 14 days of the reservation, without prejudice to the Guest’s statutory rights, including recourse to the competent consumer protection authorities.
14.2 These Terms and every Reservation are governed by the laws of the State of Kuwait, and the courts of the State of Kuwait have exclusive jurisdiction over any dispute arising out of or in connection with them.
15. General Provisions
15.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.2 No failure or delay by the Company in exercising any right under these Terms shall constitute a waiver of that right.
15.3 These Terms, the Confirmation, the applicable Outlet Schedule and the Privacy Policy constitute the entire terms governing a Reservation.
15.4 Notices to the Booking Guest may be given by SMS, e-mail, WhatsApp or through the Booking Platform, using the contact details provided at booking.
